Octavio Aguilar Montalvo and Alberta Garcia Martinez

Octavio Aguilar Montalvo (born September 1984) and Alberta Garcia Martinez (born April 1985), both residents of Staten Island, New York, applied to rent an apartment in the Great Kills neighborhood of Staten Island in September 2023. Initially, the tenancy appeared standard, and the applicants were accepted to occupy the apartment. However, starting in February 2025, both tenants abruptly stopped paying rent without providing any explanation or notice. Despite multiple attempts to communicate and request payment, they failed to respond or remedy the outstanding rent.

In addition to nonpayment, the tenants repeatedly denied entry to the apartment, even under circumstances that required urgent attention. At one point, water began leaking into the apartment located directly below theirs, posing potential property damage risks, yet they continued to refuse access for necessary repairs. This lack of cooperation created significant challenges and potential hazards for both the property and other residents.

As a result of their continued noncompliance and occupation without paying rent, a 90-day notice was formally served to Octavio Aguilar Montalvo and Alberta Garcia Martinez. When they failed to vacate the premises within the specified time frame, a holdover case was filed to regain legal possession of the apartment.
